Personal injury cases are handled on a contingency fee basis. My attorney’s fee is normally 33 1/3% of the total recovery, whether or not the claim is resolved by settlement or trial. On some difficult cases, including most premises liability claims, my attorney fee may be 40% in the event of a trial or in the event a deposition is taken after suit is filed. In the event of no recovery, no attorney’s fee is owed.
In addition to the attorney’s fee, the client is responsible for litigation and claim expenses, such as court reporter fees, filing fees, obtaining medical records, and expert witness and doctor fees (for their time in providing testimony).
In virtually all claims, I do not require my clients to pay any expenses upfront. Expenses will be recovered from any settlement or judgment proceeds, in addition to attorney’s fees. Any substantial expenses are discussed with the client before they are incurred. In the majority of cases, total expenses are less than $1000.00, and often less than $500.00.
As claim/lawsuit expenses are initially incurred by me, and eventually recoverable without interest, I have a self-interest not to incur unnecessary expenses.
